Terms & Conditions

These terms and conditions shall apply to the sale and supply of memory foam mattresses, mattresses, beds, toppers, memory foam pillows and associated services by 'The Company', to the entity hereby referred to as 'The Customer'. 'The Company' means of good practice and retail compliance is primarily regulated by 'The Consumer Protection (Distance Selling) Regulations 2000', in addition to the 'Sale of Goods Act 1979' and other statutory instruments. This document contains references to the said regulations and has been supported with background information gained from the web sites of related parties, being; OFT (Office of Fair Trading), DTI (Department of Trade & Industry) and Trading Standards Central. Any order placed by 'The Customer' whether in person, by telephone, by mail or online (ecommerce) shall form a legally binding contract of sale, thus whilst the below terms are extensive they are given to define and protect the due rights of both 'The Customer' and 'The Company'.
1. The following terms and conditions apply to all transactions. All orders made are subject to the acceptance of these Conditions, and deemed to be accepted by you when placing your order. These Conditions do not affect your statutory rights. These terms and conditions are subject to change without notice and supersede all previous editions.

BASIS OF SALE

1.1 To order Goods the Buyer must follow the procedures set out in these conditions.
1.2 Details of procedures, products, prices, payment and delivery are set out on this website. The Buyer will be given clear instructions as to how to navigate the online order process.  The Buyer will be asked to provide accurate personal details.
1.3 These terms combined with the pricing policy, order form and payment method instructions for the total agreement between Seller and Buyer.
1.4 The Seller's employees or agents are not authorised to make any representations concerning the Goods unless confirmed by the Seller in Writing.  In entering into the Contract the Buyer acknowledges that it does not rely on, and waives any claim for breach of, any such representations which are not so confirmed.
1.5 Any advice or recommendation given by the Seller or its employees or agents to the Buyer or its employees or agents as to the use of the Goods which is not confirmed in Writing by the Seller is followed or acted upon entirely at the Buyer's own risk and accordingly the Seller shall not be liable for any such advice or recommendation which is not so confirmed.
1.6 Any typographical, clerical or other error or omission on this website or in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.  All advertised sizes and measurements are an approximation only.  The Seller will endeavour to make sure that sizes and measurements are as accurate as possible but no guarantees can be given. 
 

PAYMENT FOR GOODS

2. We will treat each order for goods as an offer by you to purchase the goods subject to these Conditions. You are deemed to accept the Conditions when you place an order for goods with us. Our contract with you only begins when we confirm acceptance of your offer to purchase goods from us. An order will not take place (and we will not be deemed to have accepted your order) until we have validated and confirmed your payment. Any communication, which you receive from us prior to validation, is not to be deemed as an acceptance of your order. In the event of any pricing error occurring within our website, within a written or verbal quotation, or contained within any fax or e-mail correspondence however received, all incomplete orders shall be deemed void.

2.1    Many of the goods we sell we endeavour to publish as much information as is practical about the goods, the descriptions of the goods are as set out on the website. All drawings, photographs, descriptive matter, colour, specifications and advertising on our website are for the sole purpose of giving an approximate idea of the goods. They will not form part of the contract between us.

2.2    Your order for goods is subject to stock availability. If we do not supply goods to you for any reason we will inform you of the situation and will not charge you for those goods, and will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of any unfulfilled order.

2.3    Payment for goods must be made in accordance with our purchase procedure as set out on our website. All orders are positively credit card sanctioned prior to dispatch. We can accept no responsibility if any details you provide us with that are incorrect or if any order is held up as a result of incorrect or unsubstantiated details.
 

3    GUARANTEE

3.1    All new goods are sold with the benefit of a full manufacturer’s guarantee. Full warranty details are available with your product, or from our customer services team. If these goods are deemed tampered with in any way your warranty will become void and you will become responsible for the costs of replacement and return shipping. If no manufacturing fault is found you will be responsible for the costs of replacement and return shipping. Wherever possible we will respond to your individual circumstances. We will not be liable for any transit damage that may occur on any product you have returned to us for replacement. We strongly suggest that you make sure you have used sufficient packaging to protect your product and insure against damage before returning any product for replacement. For advice on how to pack your goods safely before return please contact our customer service team.

3.2    The warranty does not cover accidental damage, modifications to, failure(s) not due to manufacturing defect(s), when any warranty void sticker has been tampered with, failure to comply with the original manufacturer’s conditions of intended use, any accessories supplied. Caravan memory foam cannot be held responsible for any costs arising from unauthorised repairs to equipment during the warranty period. Only caravan memory foam or the equipment manufacturer or their authorised service agents can carry out any warranty work. Any unauthorised repairs or repair attempts will void the warranty.

3.3    In relation to new goods the company will accept liability for defective goods only to the extent that the company is entitled to make a claim under the manufacturer's or publishers warranty and obtain from the manufacturer or publisher a refund, credit, repair or replacement of the defective goods.

4    DELIVERY OF GOODS

4.1    Delivery of the goods shall be made to UK mainland and Europe addresses only and must be signed for. The address will be that registered with your payment card issuer, unless you request otherwise and we agree to such a request (at our sole discretion).

4.2    We will endeavour to deliver your standard sized mattress within 3 - 5 days, custom cut mattresses please allow between 3 - 5 days after proofing and agreeing by email your exact sizes but time shall not be of the essence. If we are unable to deliver the goods for any reason you will be notified and will not be obliged to pay for the goods. However, we shall not be liable for any loss, which may be suffered by you caused by any delay of delivery unless caused by our negligence. If delivery of the goods is delayed by more than 30 days, you shall be entitled to contact us and cancel the order. Any monies paid in respect of the goods, which are not delivered, will be refunded unless the mattress has been custom cut to your size or shape as we cannot re stock that mattress.


RETURNS POLICY
4.3    Goods, other than faulty goods may not be returned after 7 days unless we agree that there is good reason for us to receive such goods back. If we agree to accept these goods back into stock they are subject to a £60 re-stocking fee. Incorrectly ordered goods or non-delivery (customer out) items are also subject to a re-delivery fee. We regret that we cannot accept returns of the following: memory foam pillows, mattresses and toppers that have been made to a bespoke size or personalised. The above products will be exempt from the statutory 7 day cooling off period. We recommend that you make full use of our sales team for advice prior to purchase. We adhere to the Customer Protection (Distance Selling) Regulations 2000 No. 2334.

4.4    If goods arrive in a damaged condition you must inform us within 24 hours. We shall arrange collection of the goods (other than used goods) and will replace the goods at no extra charge.

4.5    We will deliver to business addresses at your request but stress that if instructed to do so, the card used in the transaction must be officially registered to that address. Also you are agreeing that anyone situated at your business address has your written authority to accept goods on your behalf. We will accept no responsibility for goods once they have been delivered to and signed for at the requested address.

5    CREDIT & EXCHANGES

We will provide a full refund (excluding delivery charges) if the product you have selected is found to be unsuitable within 7 working days following delivery, providing the product is returned in it's original packaging, in 'as new' condition. Again this does not apply if you have a custom cut mattress.
We adhere to the Consumer Protection (Distance Selling) Regulations 2000 No. 2334.

5.1    All returns carriage costs will be borne by you the sender

We will use this information to deal with your enquiries, supply the products to you, operate your customer account and contact you where necessary about your order. If you contact us with an enquiry we will collect your contact details and use them to respond to your enquiry. We may respond by telephone, post or email. If you request a down loadable information pack we will contact you at a later date to check you received it and enquire as to whether you want to place an order.

All information that is essential for us to collect in order to process your order or enquiry is marked with an asterisk in the collection field. Any information that is not essential does not have an asterisk in the collection field and you do not have to provide us with this information. The information you provide will be held on a secure server. It may be accessed by our staff and by those who provide support services to us. We may also share it with third parties where necessary to provide services to you, process payments or fulfil or deliver orders if required or permitted by law. We may pass aggregate information on the usage of our site to third parties but this will not include information that can be used to identify you.
On occasions we will send you brochures and other marketing information such as special offers (by email or post) we will not share your information with any third party for marketing purposes without your consent.

We do our best to ensure that all information held relating to you is kept up-to-date, accurate and complete. However we also rely on you to notify us if your information requires updating. We will respond to requests from you to update your information in an efficient and timely manner.
